The challenges and the demands for change wrought by globalization did not leave the legal and judicial systems of the two neighboring countries in the Far East, Japan and the Republic of Korea, untouched in its wake. This study is the first ever undertaking to provide a sociological account for how similarly or differently their respective legal systems and professions have coped with and/or resisted those challenges and demands with respect to civil litigation, judicial career patterns, corporate practice, and judicial reform, especially the recent introduction of each country's new law school system. More specifically, a comparative analysis of two legal system, both of which were based on the Civil Law model, raises interesting questions such as: Are these two legal system still similar today? If they exhibit any differences, what are those differences and to what extent? What elements may account for those still remaining similarities and those differences that these similarities and differences be attributed to legal culture? The co-editors, Professors Dai-Kwon Choi and Kahei Rokumoto, both of whom are leading legal sociologists in their respective countries and of international high repute, each contribute some key chapters to this book. |
